These Terms of Use (“Terms”) were last updated on 1st August 2024.
Please review these Terms carefully as they serve as an enforceable contract between Reskills Edtech Sdn Bhd (“Reskills”, “Our”) and you that contain important information about your legal rights, remedies, and obligations.
Reskills’ mission is to bring education and knowledge into the lives of many through learning. Educations providers (“Coaches”) can register with us to educate Reskills’ subscribers (“Learners”).
If Coaches are providing a class on Reskills platform, Coaches must agree to the Terms.
Reskills website and apps that have details about your browsing and app activities and app usage that might possibly to be sent from you to third parties who provide services to Reskills. By using our Services, you consent to these communications between Reskills and its Stakeholders.
1. Accounts
You need an account for most activities on our platform. Keep your password somewhere safe, because you’re responsible for all activity associated with your account. If you suspect someone else is using your account, let us know by contacting us at support@reskills.com.
You need an account for most activities on our platform, including the subscription to access content. When setting up and maintaining your account, you must provide accurate and complete information, including a valid email address. You have complete responsibility for your account and everything that happens on your account, including for any harm or damage caused by someone using your account without your permission. You may not transfer your account to someone else or use someone else’s account. If you contact us to request access to an account, we will not grant you such access unless you can provide us with the information that we need to prove you are the owner of that account. In the event of the death of a user, the account of that user will stay dormant.
You may not share your account login credentials with anyone else. You are responsible for what happens with your account and Reskills will not intervene in disputes between coaches or learners who have shared account login credentials. You must notify us immediately upon learning that someone else may be using your account without your permission (or if you suspect any other breach of security) by contacting us at support@reskills.com. We may request some information from you to confirm that you are indeed the owner of your account.
Learns and Coaches must be at least 18 years of age to create an account on Reskills and use the Services. If you are younger than 18, we encourage you to invite a parent or guardian to open an account and help you access content that is appropriate for you. If you are below this age of consent to use online services, you may not create a Reskills account. If we discover that you have created an account that violates these rules, we will terminate your account. Under our Coaches Terms, you may be requested to verify your identity before you can secure any live session on Reskills.
2. Payments, Credits, and Refunds
When you make a payment on subscription, you acknowledge that all subscription are non-refundable. In all online subscription, offline scratchcard or promotional codes.
3. Gift and Promotional Codes
Reskills or our partners may offer gift and promotional codes to students or visitors in events. All these gifts or promotional codes are unable to be refunded to cash, points or rewards.
4. Content and Behaviour Rules
You can only use Reskills for lawful purposes. You’re responsible for all the content you provided in the platform.
You may not access or use Reskills for unlawful purposes. Your use of Reskills must comply with applicable local or national laws or regulations of your country. You are solely responsible for the knowledge of and compliance with such laws and regulations that are applicable to you.
5. Reskills’ Rights to Content You Post
Coaches do not retain ownership of content and we are allow to share Coaches content to anyone through any media, including promoting it via advertising on other websites.
All OnLive contents and recordings are Reskills’ property and any unauthorized copying or reproduction is strictly prohibited.
6. Using Reskills at Your Own Risk
Coaches can use Reskills to create and publish content. If anything goes wrong or your content maybe unlawful, the Coaches are require to take his own risks and liability.
Reskills will not review or edit any of the contents for legal issues, Reskills will share the recordings to any regulatory parties if required or requested. All contents will be from the Coaches during their OnLive session.
7. Reskills’ Rights
We own the Reskills platform and Services, including the website, present or future apps and services, and things like our logos, API, code, and content created by our employees. You can’t tamper with those or use them without authorization.
8. Miscellaneous Legal Terms
These Terms are like any other contract, and they have boring but important legal terms that protect us from the countless things that could happen and that clarify the legal relationship between us and you.
9. Binding Agreement
You agree that by registering, accessing, or using our Services, you are agreeing to enter into a legally binding contract with Reskills. If you do not agree to these Terms, do not register, access, or otherwise use any of our Services.
If you are an Coach accepting these Terms and using our Services on behalf of a company, organization, government, or other legal entity, you represent and warrant that you are authorized to do so.
Any version of these Terms in a language other than English is provided for convenience and you understand and agree that the English language will control if there is any conflict.
10. Personal Data Protection Act & Confidentiality.
You acknowledge that when you access and use the Platform, we may use automatic means (including, for example, cookies and web beacons) to collect information about your use of the Platform. You may also be required to provide certain information about yourself as a condition to accessing and using the Platform or certain of its features or functionality. All information we collect through or in connection with the Platform are subject to our Privacy Policy.
We will process and may disclose personal data including sensitive personal data (as defined in the Personal Data Protection Act 2010) relating to you and/or your affiliates in accordance with our Privacy Policy and all applicable laws, and you hereby consent to the processing and disclosure of such data. You agree to keep us informed of any changes to your personal data at all material times. In any event, should any such necessity arise to obtaining the consent, authorisation or permission of any of your affiliates in relation to the processing and disclosure of their personal data, including sensitive personal data (as defined in the Personal Data Protection Act 2010), then such consent, authorisation or permission is deemed to have been obtained by you unless communicated otherwise to us.
Certain services or functionalities made available via the Platform are and may be delivered by third party sites and organisations. By using any service or functionality originating from Reskills, you hereby acknowledge and consent that Reskills may share such information and data with any third party with whom Reskills has a contractual relationship with to provide the requested service or functionality on behalf of users and customers of the Platform.
11. Updating These Terms
From time to time, we may update these Terms to clarify our practices or to reflect new or different practices (such as when we add new features), and Reskills reserves the right in its sole discretion to modify and/or make changes to these Terms at any time. If we make any material change, we will notify you using prominent means, such as by email notice sent to the email address specified in your account or by posting a notice through our Services. Modifications will become effective on the day they are posted unless stated otherwise.
Your continued use of our Services after changes become effective shall mean that you accept those changes. Any revised Terms shall supersede all previous Terms.
